Ira Matetsky’s latest article entitled “What Lawyers Now Need To Know About COVID-19 Tolling in New York” has been published in the New York Law Journal. In the article, Ira analyzes the COVID-19 executive orders that tolled the statutes of limitations and application of the toll by the Appellate Divisions and Court of Appeals, as well as its application in the Federal Courts where the statute of limitations is governed by New York State law. Ira aptly concludes that “the court’s decisions should remove any lingering uncertainty surrounding this issue in state-court cases, as well as in federal cases in which the statute of limitations is governed by New York State law,” although the toll is not likely to apply where federal law prescribes the statute of limitations.
