Congratulations to Vincent Nagler and the entire Healthcare & General Liability Defense Group for obtaining a unanimous defense verdict in Supreme Court, Kings County. This case presented unique challenges for the defense. The 52-year-old patient was non-verbal due to cerebral palsy and relied on his mother (the plaintiff) as his primary caregiver and communicator. The mother claimed to have raised complaints of trouble swallowing in August 2017, which was contradicted by the evidence presented at trial, which included several critical inconsistencies with the mother's sworn testimony. Our expert in GI Oncology testified to the lack of routine screening for esophageal cancer and emphasized that late-stage diagnoses are unfortunately common, reinforcing the defense’s position. Despite the application of the "lost chance" doctrine, and the loss of two jurors on the final day, the jury returned a unanimous verdict in two hours. Obtaining this verdict for our client was a true team effort by Vinny, Danielle Bennett, Kaitlyn Furrer, and Allison Schoer.
