In this week's "Locke on the Law," Partner and Chair of Dorf Nelson & Zauderer LLP's Intellectual Property Department, Scott Locke, discusses the implications of the TRAIN Act for copyright holders.
"Adding to the growing number of artificial intelligence ("AI") related bills that have been introduced in Congress is the Transparency and Responsibility for Artificial Intelligence Networks (TRAIN) Act. Under this act, copyright owners would be able to compel AI model developers to disclose whether any of the copyright owners' works were used to train their AI models. We don't expect the TRAIN Act to become law before the current session of Congress ends. However, we expect the next Congress to revisit how best to empower copyright holders to protect themselves against the unauthorized use of their works by developers and users of AI models."
