The plaintiffs filed a petition for declaratory relief against our client claiming that a deed purporting to transfer the subject property was forged. The Litigation Department, led by Jonathan Nelson, successfully defended the petition and the Court dismissed it. Rather than appeal the order of dismissal, plaintiffs filed another action against our client alleging the same facts and seeking the same relief as the prior petition. Our litigation team was again successful in having the second complaint dismissed on the ground ofres judicata.
