Commercial Real Estate and Land Use Department Co-Chair Richard Klein was recently tested and, unsurprisingly, vindicated, for the sound legal advice he provided to a long-time client, the Marbury Club Condominium.

The issue centered on a tenant-owner who had repeatedly attempted to secure a seat on the condo’s board. Richard consistently advised that the individual was ineligible under the condominium’s bylaws, as the unit was owned through an LLC, rather than in the individual’s personal capacity. After attempting this unsuccessful maneuver approximately three times, and consistently denied upon Richard’s counsel, the individual ultimately challenged Richard’s interpretation of the bylaws by filing an Article 78 proceeding. The court recently upheld Richard’s interpretation of the bylaws, a significant win and a major relief for the client.
