Locke, Partner and Chair of Dorf Nelson & Zauderer LLP’s Intellectual Property Department, has recently published an article in the New York Law Journal entitled “Formalizing the test for Trademark Law’s Foreign Equivalents Doctrine.” In the article, Scott discusses the Court of Appeals for the Federal Circuit’s recent decision, In re Vetements Group AG, in which the court, for the first time, provided a framework under which to analyze issues related to if and when trademarks that use foreign language words should be translated into English for analyzing whether those trademarks are protectible or likely to be confused with other trademarks.
