Congratulations to Partners Mark C. Zauderer and Jason Cohen for their significant victory in the Appellate Division. Mark and Jason were brought on as co-counsel by Susman Godfrey in 2021 to represent BML Properties Ltd., the developer of the 1,000+-acre Bahamas luxury casino, golf, and family resort Baha Mar, in an action against a Chinese state-owned construction company and related entities. On April 8, 2025, the Appellate Division, First Department affirmed in all respects the trial court’s judgment and decision finding the defendants liable for breach of contract and fraud, and awarding damages to our client totaling in excess of $1.6 billion. The trial court’s decision followed an eleven-day trial before New York County Commercial Division Justice Andrew Borrok, who found, among other things, that defendant China Construction America Inc. and related companies, caused and concealed massive construction delays and sabotaged the project. Mark and Jason have represented BML since 2021 and have been involved in all aspects of the case, including the trial and appeal.
